Terms of Service

By accessing or using the Kliiink service ("Service"), operated by Solklar AS ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including dental practices, clinic administrators, and any individuals who interact with the Service.

Kliiink provides an AI-powered dental receptionist service that includes:

• Automated phone call handling for dental practices
• Appointment booking and scheduling
• SMS notifications and appointment confirmations
• Call transcription and logging
• Integration with practice management systems
• 24/7 overflow and after-hours call support

The Service is designed to assist dental practices with phone management and should be used as a supplement to, not a replacement for, professional staff judgment.

To use the Service, you must:

• Be a legitimate dental practice or authorized representative
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be at least 18 years of age

You are responsible for all activities that occur under your account.

Billing Terms

• Subscription fees are billed monthly in advance
• Payments are processed securely through Stripe
• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months or unused time
• We reserve the right to change pricing with 30 days notice

Free Trial

New customers receive a 14-day free trial. No credit card is required to start the trial. You will not be charged unless you choose to continue after the trial period.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service for any practice other than a legitimate dental or healthcare practice
• Use the Service for any illegal or unauthorized purpose
• Abuse, harass, or harm other users or the Service infrastructure
• Attempt to gain unauthorized access to any part of the Service
• Resell, redistribute, or sublicense the Service to third parties
• Use the Service to transmit spam, malware, or harmful content
• Interfere with or disrupt the Service or servers
• Remove or alter any proprietary notices or labels

The Service, including all AI technology, software, algorithms, designs, trademarks, and content, is owned by Solklar AS and protected by intellectual property laws. You may not:

• Copy, modify, or create derivative works of the Service
• Reverse engineer or attempt to extract source code
• Use our trademarks without written permission
• Remove any copyright or proprietary notices

You retain ownership of your data and content that you submit through the Service.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

You are responsible for complying with all applicable privacy and data protection laws in connection with your use of the Service and the patient data you process through it.

We disclaim all warranties, express or implied, including but not limited to:

• Merchantability and fitness for a particular purpose
• Accuracy or completeness of any information
• Uninterrupted or error-free operation
• Results obtained from use of the Service

Important Notice

• Kliiink is NOT a replacement for emergency services. For medical emergencies, always call 911 or appropriate emergency services.
• AI technology may occasionally make errors. Human oversight is recommended for critical decisions.
• The Service should not be used as a substitute for professional medical advice.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOLKLAR AS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from service interruptions or errors
• Any amount exceeding the fees paid by you in the 12 months preceding the claim

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Solklar AS and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of any third-party rights
• Any content or data you submit through the Service

Either party may terminate this agreement at any time:

• By You: Cancel your subscription through your account settings or by contacting support
• By Us: We may suspend or terminate your access for violation of these Terms, non-payment, or other reasons at our discretion

Effect of Termination

• Access to the Service will cease at the end of your current billing period (if cancelled by you) or immediately (if terminated by us for cause)
• Your data will be retained for 30 days after termination, after which it may be deleted
• You may request export of your data prior to termination
• Sections relating to intellectual property, limitation of liability, and indemnification survive termination

Any disputes arising from these Terms or the Service shall be resolved as follows:

• Informal Resolution: We encourage you to contact us first at [email protected] to resolve any disputes informally
• Mediation: If informal resolution fails, disputes may be submitted to mediation
• Legal Proceedings: Any legal proceedings shall be conducted in accordance with the governing law provisions below

Any legal action or proceeding relating to these Terms shall be brought exclusively in the courts of Norway, and you consent to the jurisdiction of such courts.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on our website
• Sending an email notification to registered users
• Updating the "Effective Date" at the top of these Terms

Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

• Entire Agreement: These Terms, together with our Privacy Policy and SMS Terms, constitute the entire agreement between you and Solklar AS
• Severability: If any provision is found unenforceable, the remaining provisions will continue in effect
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision
• Assignment: You may not assign your rights under these Terms without our consent
• Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control
